Maybe Charles Stewart, a guy with rap sheet that includes convictions for drug offenses and unlawful possession of an assault weapon, wasn't the best person to punish his 4-year-old son for misbehaving at day care.

The 31-year-old Mounds View man has been charged with felony malicious punishment of a child, after allegedly trying to haul the kid over his knee at 4 a.m. on May 6 and paddle him, and breaking his arm instead.

The cops found out about the injury after they got a call from a nurse at North Memorial Medical Center in Robbinsdale.

The Pioneer Press reported that:

He said his son was struggling and squirming while he was trying to put the boy over his lap. At one point, the boy fell off his lap and twisted around. Stewart said he heard a crack and knew the arm was broken.

A doctor who examined the child said the break looked like an accident.

Stewart's been ordered to stay from the child.
