• The law in MN is clear. MN statute 609.02 defines �Dangerous Weapon� which includes a knife because it has been proven and is a fact, that a knife can produce death or great bodily harm. If attacked with a dangerous weapon, the victim can defend him or herself with reasonable force. In this scenario, the gun and the knife are equal under the law and the bouncer�s level of force is therefore reasonable. See MN statute 609.06 and 609.065. Training: First, defensive firearm training teaches to shoot center of the largest exposed mass. In most situations, this is most likely the chest area. Shooting the knife out of the hand, shooting the leg or arm is a product of Hollywood movies and is not for real-life deadly encounters. Second, defensive firearm training teaches to keep shooting until the threat has passed. People on drugs or alcohol perpetrate many deadly encounters. These people cannot be reasoned with and in many cases are so high they continued to be a threat after being shot multiple times. Given what we know today, I applaud the bouncer for attempting to use the baton before reaching for his gun. Based on the circumstances, I believe the bouncer did everything right based on statute, case law and the training given to those with a permit to carry a firearm. As someone suggested, we all make mistakes. Paying for the mistakes that we make comes at different costs. Cheers!

• I've made LOTS of mistakes in my life. None of them involved the attempted murder of a bouncer with a knife. Justified.

• I have now read comments on this in multiple places. They all read fairly similar - "a nice guy made a mistake, we all have". You know what? Wrong. This is not "a mistake". A mistake is peeing on you shoe while drunk. A mistake is giving a guy a 20 instead of a 10. A mistake is punching a man in anger over some words. Going home to get a knife, coming back, cutting up a guy is not a mistake. It's a planned murder attempt. "we all" have not done that. Getting shot in response is the logical conclusion of trying to kill someone. Yes, he is dead. Yes, he has a family. Yes, it's terrible. None of this diminishes the fact that he was trying to commit murder at the time of his death.That is not a trivial mistake.

• I've been a bouncer, and I've been thrown out by them, too. Did I come back with a knife to kill the bouncer, even though I was drunk and angry? No, I didn't. I've had knives pulled on me twice. Once, in Minneapolis, I had no gun, and I was lucky they only wanted the money in my pocket. Now, I pack. The next time, in Edina, if you can believe it, the guy pulled his knife out, I pulled my gun out. He left. I'm glad I carry now, and I'm glad this bouncer was able to save his own life. No doubt he's pretty shook up, I hope he has his life go back to normal quickly. I only have one question. If Tirso's mom knew he was headed out to do violence with a big knife, but couldn't persuade him to stop, why didn't she call the cops herself? If she had, her boy might be alive today.

• I have worked as a bar security guard for about 8 years now and hate to see things like this, but it unfortunately happened. I can tell you that, from the reports I've read, and my experience as a bar employee and a privately contracted security guard with use of force training from the police department, the shooting was justified. Unfortunate, but justified nonetheless. When acting in a capacity that requires use of force, the security personnel must use an amount of force one level higher on this scale to be considered using "necessary" force. Any more than one level could be considered excessive. The scale is here: Presence, verbal, light physical contact, herder contact not meant to result in harm, eye irritant spray, hard contact with hands meant to halt an attacker and could result in bodily harm,blunt weapon (asp/baton), deadly force is only to be used when you or another persons life is in danger. It seems as if the security guard used the asp to prevent the shooting of this man, because he could have justifiably used the gun immediately when his attacker used the knife, which is a deadly weapon. Because nobody in their right mind actually wants to shoot somebody, he used the asp. When that failed to fend off the attacker, he did what was necessary to prevent HIS OWN MURDER. Again, both sides of this are sad and I feel for his family, I truly do. But he was attempting to MURDER someone. First degree nonetheless because he went home and got a knife and returned specifically to KILL someone. Here's a tip for all of you that are bashing bar security guys; don't go to bars if you don't like them. The VAST majority of security guys don't want a fight. Honestly, most of them do the job for two reasons; because they like the women and because when the s**t hits the fan they can take care of business. That's it. Don't act like an a**hole and don't get blackout drunk and you won't be asked to leave. The bar wants to make money, and they'll keep you there as long as it's profitable. As soon as you turn into a liability, you gotta go. Deal with it and see ya next week. Follow those rules and everybody will have a good time.

• Rob, you are probably the most level-headed poster here. In the event of an attack, anyone with firearms training (Concealed Carry, law enforcement, military, etc.) is taught to shoot until the threat has stopped. It seems, from evidence and eyewitness accounts, that the bouncer fired a "double-tap" (two quick successive shots). There are several reasons for this, primarily, the immense amount of data showing that a single 9mm round is often ineffective at stopping an attack. Although Tirso was shot "multiple" times, that amount was two. The bouncer didn't "unload" on him. The bouncer did try to use an ASP (expandable baton) to stop the attack (enduring cuts from his attempts) and when that failed he had no other choice but to resort to the firearm. Pepper spray and Tasers are effective means of less-than-lethal force. So is an ASP, which in, in this case, was ineffective. Data proves that there is a high likelihood of injury/death from a knife attack if the attacker is within 21 feet. We cannot assume that pepper spray or a Taser would have sufficiently stopped the attack given they were less than 3 feet apart, especially considering the ASP did not work. The bouncer was released from custody because the investigation lead the police to believe that the shooting was justified. In all honesty, many with high-level firearms training, including the Minneapolis Police, likely would have skipped the ASP and gone straight to the firearm. Tirso may have been a good friend and family member to those who loved him but on that night he mad a very poor choice and became an attacker. His attack lead to his death. I am sorry for his family's loss, as I am also sorry for the bouncer and his family. Unfortunately, this entire incident was 100% preventable if Tirso had remained calm, slept on it and complained to bar ownership at a later time. We don't know what transpired during the time that Tirso was asked to leave but it certainly was not worth his life. Arguments happen. Names, even terrible, hateful ones are used. None of them warrant attacking a man with a knife. This truly is a tragedy for all parties involved. I hope that in time they can find peace.

• I remember Tirso from work. He was a pretty chill guy and I remember him for being such a hard worker. I won't stand up for Tirso just because I was friends with him at my job. He obviously was in the wrong. Nobody pulls a knife on anyone unless they are meant to cause bodily harm. I believe the bouncer did everything he honestly could to try and resolve the situation. His life was at stake. The man is trying to do his job and is trying to live his life just like everyone else. It's kill or be killed. It's too bad it had to end like this. I think the bouncer should carry a tazer from now on instead of a night stick. Night sticks cause injuries but they don't disable a target instantly whereas tazers strike the central nervous system disabling them immediately allowing you to disarm the attacker. • Pepper spray works really well, so does MACE. I agree the bouncer has to defend himself, as he did, but these non-lethal options disable attackers immediately.

• I have been to Grumpy's more times than I would like to admit, and have *never* seen any inkling of racism there. It is a melting pot of people from all over Northeast, including blue/white collar, old/young, black/white/Latino/Asian/Native American, rich/poor, et al. • I can only imagine the pain and suffering that Tirso's family must be experiencing. However, I can't help but thinking this pain and suffering would be equally great for the family of a bouncer trying to make a living at a quiet bar in NE Minneapolis. The simple facts as we know them: Tirso was thrown out of a bar. He left and later returned with a knife. He attacked the bouncer who threw him out. Said bouncer tried to stop him with a baton and, after sustaining defensive wounds, drew his gun to defend his own life. The forensic evidence and multiple witnesses corroborate this story, hence why the bouncer was detained, not arrested. Even Tirso's mother's comment about pleading with him not to return only makes me suspect he planned to go back there and attack the bouncer and she knew it. If that bouncer did not have a carry permit and a firearm, it is highly likely he would be dead. Then comments like, "Tirso made a mistake, which we all have." and "He was a good kid." would not have stopped him for standing trial for murder.

He was carring a gun. 5. He had a permit for the gun (most police officer do.) 6. He knew how to effectivly use the gun. Which leads me to the rest via deductible reasoning. Seragent, Chief or Mayor: Get rid of this guy for the following reasons: 1. He is incopetent: He coudn't handle the suspect with the baton even though he was supposedly trained to use it. 2. He used eccessive force to apprehend a suspect (multiple shots to the chest). 3. He is litterly a loose cannon. Any police officer which would unload a gun multiple times into the suspect is a loose cannon and should be fired. This type or person is called a THUG. They are power hungry. He is to apprehend the suspect not kill them. I don't agree that Tirso did the right thing going back to the bar but he definatally didn't deserve to get murdered. Yes I said murdered. Multiple shots to the chest (especially if it is a police offficer) is murder. Bill, is this your partner? I don't carry a gun, yet.

• I used to love this bar, but this Bill guy is such a douche I stay away when he is working. Bouncers think they can do what ever they want and get away with it. It is just not right. Why does a bouncer in NE need to be kicking everyone out in the first place. Grumpy's a low key spot that probebly doesn't even need a bouncer and this kid would have never come back with a knive if this douche was not there being a macho a-hole.

• I know Tirso and his mother. Tirso made a mistake, which we all have. I know that what ever happen before in that bar, must of really pissed him off. Can any witnesses tell what happen before he got kicked out? Was humiliation to Tirso involved? I wish Tirso wasnt at that bar or any bar that needs security. It shocks his family and friends that this actually happen, So when somebody says that he was a good kid. HE WAS

"And you did wrong." Actually, he did everything right. Your son attacked him with a knife, he tried to defend himself with a baton, and when that failed he revoked your son's right to life. Perhaps if you look in the mirror, you will find it was you that did wrong, by raising such a son.
