Synthetic drug ban will go into effect Friday, judge orders

A Hennepin County judge denied a motion to delay the ban on synthetic drugs today, meaning the Minnesota law will go into effect Friday as planned.

The motion was filed by a collective of head shops that have been diligently fighting to keep synthetics legal. They filed a lawsuit against the state of Minnesota earlier this week, arguing that the ban is unconstitutional and not supported by scientific research.

"It's just based on stories that have no scientific backup," Marc Kurzman, attorney for the head shops, told us in an interview earlier this week.

Gov. Mark Dayton signed the ban into law in late May, less than two months after a mass overdose of 2C-E -- a legal synthetic -- in Blaine that left a 19-year-old dead. The ban is extremely broad, criminalizing everything from synthetic pot to bath salts.

In his order, the judge denied allegations that the law was unreasonably vague. He also cited that the executive director of the Minnesota Board of Pharmacy testified to the Legislature of the dangers of synthetics, so the ban isn't completely without scientific backing.

Kurzman disputes several pieces of the judge's ruling, and already has plans to fight the judge's order.

    This is ridiculous. I'm so sick of seeing drunk drivers everywhere. Maybe alcohol should be illegal too? Just because this doesn't fall into "I like to do it too" it gets banned. Now everything is going back underground. Sad, really.

    Did everyone forget that Dayton was nicknamed "The Blunderer" by Time magazine and was listed as one of the 5 worst senator of his time?  It is a wonder that this guy ever even got elected governor in the first place.  People have such short term memories...

    they dont even sell 2CE at stores u have to get that online

    all this ban is going to do is take money away from headshops, take taxes away from our state, and in about a weeks time, some whole new chemicals will be on display for kids to try, without any kind of warning or information available whatsoever

    time to go ahead and legalize marijuana so these stupid synthetic drugs have no reason to be used in the first place, pull your head out of your ass MN - the war on drugs has been won by organized crime, and all of the money wasted locking people up for pot and synthetic pot is money that can be used in other areas of our economy

    So ridiculous. Mindless bans based on stories. Yet alcohol and cigarettes can be bought at any corner store. Scientific proof they are killers yet no one moves to bN them.
