Amy Senser will stand trial for criminal vehicular homicide

Amy Senser will stand trial on criminal vehicular homicide charges April 23, a Hennepin County judge ruled this morning.

Senser allegedly ran over Anousone Phanthavong, the head cook at True Thai, last August, and left the scene of the accident. Prosecutors unveiled an amended complaint late January alleging that Senser hit Phanthavong then returned to the scene of the crime, the Riverside exit of I-94.

The revised complaint contains witness statements that Phanthavong's car was "clearly visible" and there was plenty of time to stop. It also contained witness statements that a Mercedes Benz like Senser's was "weaving out of its lane," and that Senser slept on her porch the night of the accident.

Senser's attorneys attempted to get the charges thrown out, but a judge ruled today that Senser will stand trial for criminal vehicular homicide.

The Sensers have never denied that Senser was driving the vehicle. They deny that she knew she hit someone that night.

A jury will decide the question this spring, according to published reports.

Well Joe, it was about time for a newer Trophy Wife anyway ...

This whole case is extremely strange. But I agree with everyone saying its going be a media circus. Problem is, I don't know where you could move it.

Whilst she certainly deserves a fair trial, all this complaining about online messages is a distraction.  It's not as if Senser's lawyer doesn't ALSO have a very public stage.  He's whined in articles about every little thing, and all the so-called unfair treatment she's received.  Takes two to tango.

But it only takes one person to make sure that the victim's arrest record was leaked within days of the hit and run.

I've been reading every story on this case, and the vehemence of Amy's critics has always been in direct proportion to the number of pro-Amy trolls in the comments.

It's been pretty obvious from the start that they're trying to get away with murder here.

I do not want to see Amy Senser unduly crucified but she needs to be held accountable for her actions. Only a very small percentage of criminal cases ever make it to court because the lawyers and judge typically try to work out a plea bargain. When those attempts fail and the case goes to court the "defendant" is "going all in" as it regards their future. If found guilty, judges typically have an upward departure at sentencing due to having been involved in pretrial discussions/plea bargains and it is usually based on the fact that the defendant was given an opportunity to plead and in essence accept responsibility for their actions and "hopefully" show remorse. If Amy Senser is found guilty by a jury, I certainly hope the judge takes her "gamble" into consideration.

This whole thing has smelled rotten from the start. Joe is doing her no favors by enabling her addiction and allowing her to side step the consequences of that addiction.

How many people "hit something" while driving and rush home to call their attorney? If you knew it wasn't a person, most people would be calling their insurance agent. As for fearing for his client's safety, what a laugh....there are pedophiles, rapists, murderers etc. that are accused of much worse crimes who don't worry about their "safety". I idea of moving the trial due to publicity is also laughable, who does Nelson think his client is, the President of the U.S.? Moving the trial out to the country only allows Nelson to make the trial all about local Vikings hero, Joe Senser, and to play off the sympathy that he would get from that glorious history.

This strikes me as a bad move. She's going to become a media circus, and regardless of the verdict she has already lost in the court of public opinion. If I were her lawyer I would have said plead guilty, do your community service, go to rehab, and  put it behind you.

Ah well, she deserves everything she's going to get.

I am not defending her alleged actions, but her lawyer has already requested a change in venue for the trial and I think that is a good idea.  She obviously can not get a fair trial in Hennepin County.  Another thing.....if she supposedly was very intoxicated when she hit this man.....and according to witnesses that her vehicle was "weaving out of its lane", how did she manage to drive all the way back out to Minnetonka (or Wayzata or where ever she lives) and not get managed to get pulled over?  Anyone who uses I-394 (whether day or night) knows that the State Patrol are thick as flies on that stretch of freeway looking to nab Mercedes Benz and BMW owners who are going one mile over the speed limit.  I highly doubt if she was that fucked up, she could have made it all the way home without getting pulled over.  Also, the fact that the guy that she allegedly ran over was high on cocaine (which amusingly, City Pages never mentioned in their article) will be a major issue in this trial.  Regardless, whatever your opinion is of Amy Sensor, she deserves a just and fair trial.  And she certainly won't get one in Hennepin County.

Well said Jeff and exactly right

Yes, it's all a conspiracy against luxury car drivers on I-394... wait, what?

Nelson's request won't make any difference. Out state Minnesota reads the same newspapers as Twin Citians.

No, this is all about trying to get the whitest jury possible....

You're not allowed to run over and kill a person on cocaine.  That is not an excuse.

Also, use her real mugshot instead of that weird BS picture her lawyer released.

Good. She drove away leaving the guy for dead when there was a hospital a block away.

I'm sorry...but I just can't understand how you can't know you hit a person? It's not like it's something small like a bird. It was enough of a hit to throw the guy, I don't care what kind of car you're driving, you're going to feel something from that. I'm glad she has to stand trial and I hope justice is served.
