Hezekiah Hamilton will not be charged with murder of Jody Patzner Jr., to be released

Minneapolis police thought they had their man last Wednesday when they arrested Hezekiah Hamilton in connection with the April 9 murder of Jody Patzner Jr. Turns out the Hennepin County attorney's office isn't as convinced.

The Star Tribune, citing comments made by attorney's office spokesman Chuck Laszewski, reports that Hamilton, 24, will not be charged with murder and will be released from custody today.

Hamilton's mom told the Strib that Hezekiah was in a nearby convenience store at the time of the shooting, and that surveillance video from the store would prove it. Sgt. Steve McCarty of the Minneapolis Police Department said police were aware of the surveillance footage before arresting Hamilton but still thought they had sufficient evidence to justify murder charges.

McCarty characterized Hamilton's release as simply reflecting the fact that the attorney's office, at this time, doesn't believe there's enough evidence to charge Hamilton. He said investigators continue to track down leads in the hopes of bringing Patzner's murderer to justice.

[Hamilton's mother] expressed disbelief that her son was involved, saying that he had a car.

"Why would my son need someone's bike when he's in a car?" she asked.

She said her son had been in a corner convenience store at the time of the shooting, and that surveillance video from the store would prove that. As emergency vehicles arrived on the scene, she said her son went to investigate what had happened and thought it was a car accident. "

He said, 'Momma, there's a lot of ambulance and police out there. It looked like a cab had hit somebody,'" she said.
McCarty, when asked about what police think of Hamilton's mother's account, refused to comment.

Meanwhile, a memorial service for Patzner will be held this Wednesday at 3 p.m. at St. Bridget's Church, 3811 Emerson Ave. N.

Interesting that City Pages does not seem to think that they owe Mr. Hamilton an apology. It is oh so easy to plaster a black man's face on your page and criminalize him. No wonder we see the sort of racist comments on these pages so often. How about some responsible journalism or is that just an old-fashioned notion?

Since the (idiot) cops were well aware of the survellience footage of  Hezekiah Hamilton, then they should have looked at it first before arresting Hezekiah. Now they may have a big fat lawsuit for their incompetency.

He was arrested in connection with the crime, which is what we posted about. When have you ever seen a media outlet write a story apologizing after a criminal is released by police? In this instance, police say they don't have enough evidence to charge him, which doesn't definitively prove he's guilty or not guilty either way. He was a suspect, and that is simply fact.

Just because HC attorney wouldn't charge this guy doesn't mean that a.) this guy didn't do it, and b.) the cops did anything wrong.  Police have very different standards for arrest than prosecutors have for deciding whether to charge at a given time.  Police need probable cause to make an arrest.  They apparently had it.  The county attorney has to make a decision as to whether, for example, just the video evidence is sufficient to win the trial: in their judgment, it apparently wasn't.  That doesn't mean that the police might not be able to find additional evidence in this case and charge this guy or someone else.  Also, just because someone hasn't been charged yet certainly doesn't mean they are innocent.

Before calling cops or others idiots, you probably should learn whereof you speak, lest you like the idiot instead.
