Wright County's handling of Brooklyn Park murder suspect "insane," says Ron Rosenbaum

Wright County's controversial handling of Eddie Mosley's rape charge may have had deadly consequences.

Last month, Mosley, 34, received a summons in the mail at his St. Louis home informing him he'd been charged with raping a 15-year-old relative in Minnesota last October and would have to appear in a Wright County court about two weeks later. He was not taken into custody, the idea being that he didn't pose a threat to his accuser from hundreds of miles away.

But less than a week after Mosley received the summons, he allegedly stormed into the Brooklyn Park home of daycare provider DeLois Brown, murdered Brown and her elderly parents, then fled the scene and headed back to St. Louis before being arrested on April 13. Mosley thought his rape accuser might be in Brown's home, police say.

So why didn't Wright County request that St. Louis authorities take Mosley into custody and extradite him to Minnesota? The Star Tribune reports that Brian Lutes, Wright County's chief criminal prosecutor, thought he was following a Minnesota rule in criminal procedure stipulating that an arrest warrant is needed only if "an arrest is necessary to prevent imminent harm." Lutes said "there was no indication of imminent danger" to Mosley's accuser or anybody else in this case.

But during an appearance on Dan Barreiro's KFAN radio show yesterday, Twin Cities lawyer Ron Rosenbaum said the idea Mosley didn't present a threat to his accuser is "insane."

"It's a mystery to me why they wouldn't have issued an arrest warrant and extradited him," Rosenbaum said. "This was a summons to appear here, [and] every mile he gets closer to [Wright County] definitionally brings him closer to the victim."

While saying he wouldn't go as far as to pin blame for the triple homicide on Wright County officials, Rosenbaum said the way Mosley's rape charge was handled "doesn't make sense."

"I don't buy the rationale that was given... nobody is going to look you in the eye and tell you that first-degree criminal sexual conduct is a nonviolent crime," he said.

Understandably, Brown's family is also baffled by the fact Mosley remained free after being charged with felony rape.

The Star Tribune quotes DeLois Brown's brother as asking several times during an interview, "Why send a summons in the mail?"

Said Rosenbaum: "I think the family has an absolutely legitimate beef."

Mosley now faces three counts of second-degree murder in addition to the rape charge.

Crime is out of control as in too much coming in from all directions (all types), money going into prisons and law enforcement down (too many perps) and soceity becoming more segregated meaning those who can afford to live in safe areas flee from the crime ridden ones. 

In this case they mailed the summons as a cost savings measure.  How many of you REALLY BELIEVE you'd get real concern on a petty crime, against you (mugging, car break in, someone stealing your ID, checks, etc) by the local police department? If you actually believe that I'm glad you are able to feel safe and protected in that false reality.

Wow!  How can a rape suspect NOT be considered dangerous?  Wright Co.'s ineptitude is appalling and the excuse for that ineptitude --their apparent belief that a suspected rapist is peaceful, kind, gentle, and just a warm fuzzy person spreading love and joy -- is even worse.  Not dangerous, phffft!   Off with some heads!!!

 Crime down but negotiations over charges increase.  Bargaining o er charges is stupid.  that fact is those who break the law should be punished.  Those who murder, rape, beat and take advantage of common people, need to be punished.  Those that introduce people that commit such crimes, need to be punished.

 You have to be really stupid if you think that this trend is related to anyone political party.  The fact that the judicial system isn't working is a direct result of the elite entities that control the legal system and laws not serving the common person.  The legal system is another gambit in which to manipulate to affect public opinion.  If common people wrote to their representatives and began giving a shit, they would take note and make a difference.  Politicians main incentives are to back things that the majority want to fulfill their "career" goals. That means people writing letters stating that criminals be dealt with in a more severe manner!!

Every other first world country on Earth has universal healthcare.  So do many 3rd world nations.   Providing healthcare makes your society stronger.   See you don't want Einstien to die because his mom couldn't get him proper healthcare at age 5.   This is basic knowledge of how society and the world works.   If America is a nation of good people we must find a way to make sure everyone has access to good healthcare no matter how poor or rich they are.  Sadly evil stupid people like you will live longer thanks to Obama's reform of healthcare but if you hate government healthcare so much move to Somalia.  They have no universal healthcare, taxes, or gun laws.  I'm sure its Republican paradise.
