The story he came up with sounds like something out of a gangster's wettest dream. O'Duffy told a St. Paul cop he was simply heeding nature's call when he made an extremely unlikely find.
From the criminal complaint:
On September 14, 2012, at approximately 2:30 PM, St. Paul police officer on patrol [sic] in the area of Bradford Avenue and Long Street... observed parked sedan in the middle of the alley behind 2289 Long Street. It was occupied by four people. The officer investigated. As he approached the driver's side door, he observed the driver rolling what appeared to be a "blunt," which is the street vernacular for marijuana cigarette. [Thanks for clearing that up, guys!]O'Duffy was arrested and subsequently charged, but he gets an A for effort.
The officer had the occupants exit the vehicle. When the driver's door opened, the officer immediately observed a pistol in the door pocket. The pistol was a Glock 22C, serial number ECP 289.
The driver, later identified as [O'Duffy], stated he found the pistol about an hour earlier while urinating alongside a nearby garage. The defendant told the officer that he found a jar full of marijuana near the pistol. The defendant did not have a permit to carry or possess a pistol at the time of the offense.
