Gay Applebee's employee brutally beaten, asked not to return by manager because of negative PR

Timothy Phares is gay. He works as a server at the Applebee's in Rice Lake, Wisconsin, and during the early morning hours of March 17 he was brutally attacked by a co-worker's husband in a Perkins parking lot.

According to Phares's account of the incident, moments before he got blasted in the head with a 2 x 4, the alleged assailant, 36-year-old Rien Hendricks, told him: "Fucking faggot, I'm going to kill you." Phares's co-worker was with her husband at the time and witnessed the incident, though she hasn't been charged with any crimes.

Phares was left with facial fractures that will require the insertion of metal plates. And to add insult to injury, according to a detailed account of Phares's plight in the Wisconsin Gazette, Phares's Applebee's manager, Tara Steinberg, told him following the attack that she no longer wanted him to come to work because the alleged assault "had attracted so much negative publicity."

But Greg Flynn, CEO of Apple American Group and owner of the Rice Lake restaurant, intervened on Phares's behalf and overruled Steinberg, and Phares remains on staff.

As the Gazette report details, Phares's sexuality has caused problems at the restaurant, and he recently put in his notice (a move he ultimately rescinded) after an ugly incident where a patron used "a number of embarrassing anti-gay and homophobic slurs while Phares was serving him."

Applebee's spokesman Dan Smith recently issued a statement addressing Phares's plight:

This very unfortunate personal situation involving two of our franchisee's employees occurred during their free time and entirely away from the restaurant. The husband of one employee has been charged by police with felony assault. The police have informed us that this individual's wife, who works at the restaurant, has not been charged and is not a subject in the investigation. The employee who was attacked is still employed with the franchisee. Although he had voluntarily resigned prior to the incident, the franchisee encouraged him to remain employed and he accepted that offer. Our franchisee continues to monitor the investigation, and if there are any further developments related to any of its employees, it intends to evaluate the information and act accordingly.
As you'd imagine, Phares told the Gazette he doesn't feel particularly safe at his job and isn't sure how long he'll stick around. Meanwhile, Hendricks has been charged with felony battery.

IT IS SO SAD THAT IN THIS DAY AND AGE THAT WE MUST STILL DEAL WITH LOW CLASS, UNEDUCATED, LOSERS WHO HAVE TO GO AROUND ASSAULTING AND HURTING INNOCENT PEOPLE FOR NO REASON; ESPECIALLY BECAUSE YOU MAY BE OF A DIFFERENT SEXUAL ORIENTATION.

YOU NEED TO SUE THE PERSON WHO DID THIS TO YOU AND I AM THINKING OF THE RESTAURANT AS WELL.

I AM NOT SURE WHERE THE INCIDENT TOOK PLACE, BUT IF YOU FEEL UNSAFE TO WORK AT APPLEBEE'S, THEN PERHAPS YOU SHOULD GET A JOB ELSEWHERE.

Mr. Phares Come work at the Saint Louis park one!! They are truely gay friendly. i know of about 7 people at that one are are either Gay or Lesbian and None of them have had any problems with this crap!!

I don't condone the attack, but there's obviously more going on here than what is being reported by City Pages and/or mentioned by the victim.  Attacks like this don't just happen for no reason.  They are a result of escalation.  I hope the full story comes to light someday.  It probably won't, though.  Not through City Pages, anyway.

I do hope Mr. Hendricks spends a long time in prison, and the medical bills for the victim are covered .

I know there are good people in Rice Lake, but it doesn't help the PR of podunk towns being backwaters full of violent idiots looking for any reason to beat up people different from themselves. Pretty bad when a small Appalachian town in Ohio (Pomeroy to be exact) puts Rice Lake to shame in its treatment of GLB residents.

This story is so sad. Tim Phares was my server the last time I dined at Applebees. He was kind, enthusiastic and an overall good worker. My daughter and I even commented on his upbeat personality and it reflected in the tip I left him. This is definitely a hate crime.

There has to be more to the story than this, I do not like the fact that they are selling it with a hate crime spin. I do not see the fact that he is a homosexual coming into play when it comes to his manager telling him not to come to work. He put a notice in before, causes problems with co-workers. I think it is too bad that he was assaulted but I think it could be more of a personality issue, rather than a sexual preference issue.

@Shawn Clark So you want everyone else in the place to lose their jobs even though most if not all had nothing to do with the incident? The mgr might be due for dismissal, but it sounds like this started at a party away from Applebees, and ended up outside of the place.

@dave548 There's always an explanation, but it doesn't mean the reason is logical.  It certainly isn't simply the "Because he was gay" reason.  Like I said, it's pretty obvious this was the result of escalation because of both parties.  It doesn't excuse the attack or mean I condone it, but the whole story does need to be told, don't you think?

@jontkernel @nate140  Yeah that kind of made it seem pretty upfront. I've been nearly attacked myself but when they asked me if I wanted them to go to jail I said no. They both got cited for Disorderly Conduct -Biased. I was completely okay with that. I wasn't injured by any means. Also, I didn't know they could modify a citation that way but they can if they simply write it up that way.

@jinxmchue @dave548 Yes definitely. The Gazette says he left the party early... how early if he was at Perkins at 6 am? Obviously there is something shady involved in all of this. Hendricks followed him to Perkins after a late night of partying? I'd like to know more.

@jinxmchue@dave548More details would be nice, but City Pages cited their source as the Wisconsin Gazzette and provided a link. with more details. They didn't embellish anything. More details would help, but long story short: Tim Phares went to a party with his sister at the Hendricks'. They claim to be treated rudely and left to go to a Perkins. Rien Hendricks and his wife followed them and Rein attacked Tim with a 2x4. Who was escalating? It doesn't help that Mr. Hendricks already had a criminal record. Its speculation, I know. The "because he was gay" argument seems more that likely to have contributed.
