Teen hospitalized with .21 BAC after partying at County Attorney Jan Jude's property

A 17-year-old in Milaca, Minnesota, was rushed to the hospital early May 27 after drinking at a graduation party on property owned by Mille Lacs County Attorney Jan Jude and her husband Russ Jude, an investigator for Mille Lacs tribal police, according to the teen's mother.

Kim Hamilton says her son, Bailey, was unresponsive and barely breathing for six to seven hours with a BAC of .21. Hamilton says she feared for her son's life when doctors couldn't wake him up.

The Anoka County Sheriff's Office is investigating the alleged underage drinking incident, confirms Commander Paul Sommer, though he couldn't offer further details. "It's just too early," he says. "I don't even want to speculate."

Called for comment, Jude sent City Pages the following statement:

It has been reported that a juvenile exhibiting signs of alcohol consumption was on my property during a graduation party for my daughter. It has also been reported that there are other minors have said they consumed alcohol on my property. I had no knowledge of any of these events occurring on my property until these reports were brought to my attention. It is my understanding that an independent investigation has been initiated. It is my hope that this investigation will reveal all of the facts about what actually occurred and, perhaps more importantly, who provided alcohol to any minors who consumed alcohol on that date. I completely support the investigation and will fully cooperate.

After the party, around 1 a.m., two of Bailey's friends woke up Hamilton and her husband to tell them Bailey had been drinking heavily. The parents walked outside to find their son slouched over and unresponsive.

"He never said anything," says Hamilton. "He didn't do anything. He didn't move. It took my husband and his two friends to get him into the car, because he was basically dead weight."

Hamilton called 911, and an ambulance rushed Bailey to the Fairview Medical Center in Princeton. Doctors brought Bailey to the trauma unit and hooked him up to an oxygen tank to help him breathe.

At one point, a doctor asked Hamilton to take a seat. "And I was like, 'Um, OK," she recalls. "And I'm like, 'Is my kid gonna be OK?' And he said, 'I don't know. I can't tell you that right now."

"We kept trying to wake him up, and he wouldn't," continues Hamilton. "They'd come in and rub his chest hard, and they'd kind of yell right next to his ear, 'Baily, Bailey, Bailey.' I tried, you know, 'Bailey, it's mom, can you move your fingers?' Can you do something?' And he didn't move at all."

Around 6:30 or 7:30 a.m., Bailey finally showed reaction after a doctor tickled his feet, says Hamilton. "He said, where's my shoes?"

Hamilton was able to take her son home later that day. It wasn't until days later that she heard the party Bailey attended was at a house owned by the county attorney and a police investigator.

"I'm in shock, I guess," she says. "I don't understand."

According to the Mille Lacs Messenger, other teenagers were also drinking heavily at the party. "My daughter was less than 20 feet from that river, and I had to pick her up and carry her dead weight," one source told the Messenger. "She could've fallen in that river and died."

Hamilton has been talking with other parents whose kids attended the party, and they are "very, very concerned" about the incident, she says. "Their kids were there and in not in a good situation either. They were close to being in the same situation as Bailey."
