I-494 chase after cop shooting was case of mistaken identity [VIDEO] [UPDATE]

Thanks to his green car and suspicious behavior, officers thought Kellum (pictured) might be a cop killer.
-- Update including details on the charges Kellum faces on page two --

Original post (August 1) -- In the chaotic moments after Mendota Heights police officer Scott Patrick was gunned down in West St. Paul on Wednesday afternoon, authorities released a bulletin asking people to be on the lookout for a green Pontiac car belonging to the suspect, Brian Fitch, who was still on the loose.

A short time later, an officer spotted a green car "suspiciously" pulling off a trail not meant for automobiles in Mendota. The driver didn't stop when an officer turned his flashers on, and soon, what looked like half the cops in the Twin Cities were following him down Interstate 494.

Here's video of the chase and its aftermath, which included one squad sideswiping the car off the road before about a dozen officers approached it with guns drawn:

But turns out the Saturn-driving suspect, later identified as 46-year-old Steven Kellum, had nothing to do with the shooting.

State Patrol spokesman Jesse Grabow tells us officers quickly realized Kellum wasn't the man they were looking for. Nonetheless, he was arrested not only for fleeing officers, but also because he refused to take a sobriety test and had unspecified drugs and drug paraphernalia in his vehicle.

Kellum was booked into Washington County Jail. A jail official tells us he's due in court today and has already been charged, though our attempts to obtain the criminal complaint have gone for naught as this is published.

Talk about being in the wrong place, at the wrong time, while driving the wrong car. We can't imagine what an allegedly intoxicated Kellum was thinking as a horde of gun-toting cops approached him.

Anyone who listens to the scanner footage knows that the police knew right away that it wasn't the same car being sought in the killing of the officer; it was the media--not the police--who made the case of mistaken identity.  The police treated him no differently than any other idiot who led police on a chase...the difference was that there were a lot more police around during the chase...

He refused a breathalyzer and there is no road side test for marijuana use so again they had no right to search the car without his permission.

Sure Ted, he had reason to be pulled over and I am glad for that but i bet he got treated way worse than he deserved while they erroneously thought he was a cop killer

I am just laughing about the comments , why argue back and forth.

Lucky no one got shot. Accidental discharges are common in these emotionally charged situations.

Here is a crazy idea, pull over! This would not have been so crazy if he would have pulled over when the cop hit the lights.

When you are drunk or high, that is probable cause to search. They are looking for more drugs/open containers.

mabe he will not drink and drive again (just hoping)

Watch the video, they pop the trunk and search the interior.

dude, I wasn't even replying to you. Did you even read the article? "A short time later, an officer spotted a green car "suspiciously" pulling off a trail not meant for automobiles in Mendota." So regardless of whether or not it was the car in question that sure seems like enough to warrant pulling someone over. Also, it doesn't even say whether or not they had to search the car to discover "unspecified drugs and drug paraphernalia in his vehicle."

Jared Jank
Jared Jank

I never said he should have been driving, I just said they can't create probable cause to pull someone over based on the coincidence of the car color and they also had no right to search the car unless the driver gave them permission.

Ted Duepner
Ted Duepner

or maybe doing the wrong illegal things that should've gotten him pulled over anyway. It's not like they busted down the door of some innocent person with the wrong house address. They stopped a guy who clearly should've been taken off the road anyway. The guy they were looking for? No. A guy who was a danger to himself and everyone else on the road? Probably.

Jared Jank
Jared Jank

So they try pulling someone over because they have the same color car of the suspect then they proceed to illegally search it? Cool.

whats really sad here people is a cop dies the whole state looks for the killer if u get murdered u get one dude that maybe gives a crap

Everything about this seems like a completely unprofessional, overly emotional response by the sheriffs?/police. How they end up pulling over a green SATURN, not the Pontiac they were looking for? Or how they approach the car in a line like the British military in the civil war, ready to shoot him execution style, while risking being shot by him from the relative safety of the car (if he was actually the guy) - to the point of almost overlapping and pointing the guns at the backs of other officers. What happened to hiding behind cover? Like oh one of their cars? Or sicking the dog on him as first contact? Or how the guy that opens the door has a rifle so he has to aim it down till it clears the door then raise it? Why did they send the rifle guy? He would never have a chance at a shot in that situation. And how they swarm him like a celebrity as soon as he is yanked out? Probably to shield the kicking and beating from the cameras. Some of them were trying to push into the pile, looking for an opening, swarming like children on a broken piñata. I get it, someone shot a fellow officer and you want to be a part of that retribution; but with brilliant tactics and intelligence like this, I fully expect to get tackled by one of these guys because I look vaguely similar to a criminal (pick one), I have short hair and drive a blue car. Oh yea, then they will shoot a dog I looked at on the internet.

I'm no apologist for modern police agression, but considering what happened here I don't see much wrong with the way this was handled.

It was the wrong guy, but they didn't kill the wrong guy, or even shoot him.

Huh, guess that's the state of the police force these days, or at least the barrage of negative coverage brought on by terrible police officers doing terrible things, that I'm applauding these guys for not killing the wrong person.

Why didn't he just pull over when the cop got behind him with his flashers on?

I haven't followed all the details of this story, and maybe it's a tactical thing, but I don't understand why the police didn't have their flashers on. RIP to the officer who was shot.

That is CLEARLY a Saturn. NOT a Ponitac. I could see that even from the back end... Cops must have been blind to that one. But it is a mistake that, understandably, was done due to the MH officer.

Funny thing, people who are intoxicated act irrationally sometimes. Hard to believe, I know, but it happens.

They did have them on, it's just that directional LED bars don't show up that well on video from a helicopter at a high angle.  But if you look close, at least on my screen you can see them, and they show up better on the squad on the left than on the right.

Same here, they handcuffed me and beat the crap out of me, then checked to see who I was. I was cuffed so tightly that I couldn't feel my hands for 6 months after that.
