Gayngs win lawsuit against CJ Starbuses

​Seven months have passed since Gayngs lost out on the opportunity to play a prominent slot at the Austin City Limits festival, which they were forced to cancel after their bus driver absconded with all of their belongings and gear. And now, thanks to a sympathetic jury in Nashville, Tennessee, the band has been "vindicated" to the tune of over $100,000 in compensatory and punitive damages.

"I am extremely relieved that the jury understood the turmoil, both emotionally and financially, the band has gone through as a result being forced to cancel our ACL performance," says Gayngs' tour manager Nate Vernon. "No amount of money can make up for being deprived of that show; however, the peace of mind which comes from justice is the next best thing."

As we reported back in October, the band lost out on their ACL gig after bus company owner C.J. Curtsinger ordered their bus driver to steal away with their gear. The band and the bus company had been in a weeks-long dispute over the charges for their bus rental, and at the time Curtsinger admitted to Gimme Noise that he had not forced the band to sign a contract and that he was aware that his actions would cost them their high-stakes show.

After suing the bus company, C.J. Starbuses, and enduring a trial in Nashville, the courts found that "C.J. Starbuses, Inc. and C.J. Curtsinger engaged in unfair and deceptive practices" and would be required to pay the band for damages.
